On Thursday, March 17, 2016, a federal jury in Dallas awarded five plaintiffs
a total of nearly $500 million in damages for injuries sustained from
defective Pinnacle hip-replacements produced by DePuy Orthopaedics. DePuy,
a subsidiary of pharmaceutical giant Johnson & Johnson, has already
shelled out roughly $3 billion for lawsuits related to injuries caused
by its line of recalled ASR artificial hips. This decision opens the door
to future lawsuits for victims of faulty DePuy implants and could mean
big trouble is imminent for Johnson & Johnson.
DePuy recalled its ASR hip implants in 2010 after reports began to surface
of high failure rates and metal poisoning in patients. Due to the devices’
metal-on-metal design, chromium and cobalt ions have been known to be
released from the implants with wear and tear, causing damage to nearby
tissues and resulting in possible organ failure. While the company’s
Pinnacle implants shared a similar metal-on-metal design, they were never
recalled, though sales of the devices ceased in 2013.
Johnson & Johnson has since strongly stood by the design, claiming
that the resulting design was the culmination of six years’ worth
of research and development and rigorous testing.
