Jones Act Claims
Seamen aren’t entitled to workers’ compensation claims the
same way other land-based professionals are. However, the Jones Act gives
injured seamen the right to sue their employer for work related injuries.
The only compensation an injured seamen can receive for their work related
injuries is through the Jones Act and other maritime laws.
A seaman is anyone who contributes to the function of a vessel while it
is on a navigable waterway. I It’s important to note that Jones
Act cases can be more complicated than the average workers’ comp
or personal injury claim. This is because determining the status of a
seaman is difficult under maritime law.
Under the Jones Act, an employer can be held liable for:
- Improper Maintenance of Equipment
- Unsafe Work Methods
- Failing to Provide Necessary Equipment for Job Duties
- Grease or Oil on the Deck
- Inadequate Training
- Assault by a Co-Worker
If you plan to file an injury claim under the Jones Act, you should speak
with our maritime lawyer as soon as possible. We can walk you through
the claim process and answer any questions or concerns you might have.
